Abstract

The democratic character of the preparation processes of the 'Turkish constitutional texts is often been the subject of serious criticism and discussion. The 1921 differs from the other Turkish constitutions in terms of both the legislative method and the democratic character of the negotiation process. In this study, the democratic character of the preparation processes of the 1921 Constitution is tried to be revealed by analyzing the negotiation and legislative method of the constitution in the framework of procedures and provisions of the internal regulation. Then, the points which the Grand National Assembly distinguishes itself from the former periods by defining itself as a 'constituent assembly', are stated. And finally, it should be noted that the 1921 Constitution continued the Ottoman tradition in connection with parliamentary continuity and internal regulations.
